MANAGEMENT SERVICES 

 

 

©     Provide Physician Medical Oversight by California Licensed Physician for the client’s AED program site

 

©     Provide annual written prescription for each AED client possesses by a California State Licensed Physician or Surgeon as required in California Code of Regulations (CCR), Title 22   

 

©     Provides initial and annual contact with county Emergency Medical Services (EMS) for proper registration/notification of AED deployment and placement. Coordinates, maintains and ensures compliance with County EMS policies.   

 

©     Following use of an AED, notifies EMS and any other appropriate individuals or agencies ensuring compliance with Federal, State and County Law.

 

©     Advises client of the State mandate for clients emergency response plan. Provides examples, templates and recommendations for client emergency response plan that complies with California Health and Safety Code.      

 

©     Following use of an AED, retrieve the AED device used from client, provide "loaner" unit and return client AED to “ready” status. Retrieve clinical data following AED use through manufacturer’s approved download program.

 

©     Advises client of California Health and Safety code regulation regarding building and tenent notifications relating to the placement of an AED in a building or business. Provides, examples and templates of AED Location Notices.         

 

©     Provide California Licensed Physician event review in addition to a verbal and written ECG interpretation by California licensed Cardiologist. Prepare and submit reports to County EMS, Coroner, hospital and any other agency, as the law requires.

 

©     Provide Legislative and FDA updates, template policies, procedures, forms, manuals and maintenance records. Provides and tracks qualified AED training as required by California Health and Safety Civil Codes.          

 

©     Provide access to brochures and necessary documents for annual distribution to staff, employees and volunteers of schools, businesses, property owners and fitness centers as mandated by State Law. 

 

©     Identify Persons to be trained in the use of AED(s) as required by CCR, Title 22. Ensure CPR/AED instruction is completed prior to deploying a purchased or donated AED(s).

 

©     Provide quality AED Program Staff to include an AED Program Liaison and other qualified personnel to offer 24-hour AED emergency contact service.

 

©     Ensure Compliance  with American Heart Association or American Red Cross training guidelines and updates as mandated by qualified instructors who administer CPR/AED training and instruction as required through CCR, Title 22.

 

©     Provide record keeping services for program management, certifications, incident correspondence, and data collection and re-certification notification.

 

©     Provide monthly maintenance check lists, cards or tags as mandated by law

 

©     Ensure compliance with all county, state and federal guidelines relating to the placement, maintenance and use of AEDs


    US Food and Drug Administration

©     Regulates AED’s as a class 3 medical devices to ensure AED’s are safe and effective.

©     AED’s are viewed by the FDA as restricted, pre-prescription devices.
©     The AED user must be trained and under the supervision of a physician.

  Public Law 105-170(1998)
©     This act may be sited as the airport medical assistance Act of 2000. Directs the Federal Aviation Administration to require AED’s at certain airports and for other purposes. In 1998 President Clinton signed Public Law 105-170 relating to AED’s on airplanes. It declares that air carriers and staff shall not be liable for civil damages in attempting to provide emergency medical assistance.
 
©     Mandating that every commercial aircraft be equipped with lifesaving equipment including AED’s and that flight crewmembers be trained in their use.
  

California Code of Regulations, Title 22

 
©     Section 100036: Mandates that a written order for the use of the AED must be made annually by a California licensed physician.
©     Section 100038: Requires AED training that complies with the American Heart Association or the American Red Cross.
©     Section 100042: Requires the following
©     An emergency response plan
©     Coordination with local EMS agency
©     Compliance with local EMS policies
©     Monthly AED maintenance checks
©     Medical Oversight by a California licensed physician

 

California Senate Bill 911

©     Provides immunity from civil liability to: 
©     Any person who in good faith renders emergency care with the use of CPR or an AED.
©     Any person who provides CPR/AED training to a person who renders emergency care.

©     A physician who provides medical authority to a person or entity that has placed an AED at their location.

©     This bill requires any person or entity that acquires an AED to comply with the following. 
©     Comply with all regulations governing the training use and placement of an AED.
©     Notify local EMS agency of the existing, local, and type of AED acquired.
©     Ensure expected AED users complete a training course in CPR/AED that complies with the standards of the American Heart Association or the American Red Cross as well as local EMS agency.
©     Maintenance guidelines set fourth by the manufacturer the AHA, The Red Cross and any applicable regulations set fourth by the federal food and drug administration and any other state authority must be complied with.
©     The AED must be checked for readiness after each use and at least once every thirty days if the AED has not been used.
©     Any person who renders emergency care to a victim of cardiac arrest by using an AED must activate the EMS system and report “any” use of the AED to the local EMS agency and the physician providing on going medical oversight.
©     There must be involvement of a licensed physician to develop and AED program and ensure ongoing compliance with regulations and requirements as stated above.
 

California Health & Safety Code Division 2.5

 
©     Section 1797.190: Establishes standards for the training and use of AED’S.
©     Section 1797.196: States that any person or entity that acquires and AED is not liable for any civil damages resulting from the rendering of emergency care.
©     Complies with all regulations governing the placement of an AED.
©     Ensures the AED is maintained and regularly tested.
©     That the AED is checked after each usage and at least every 30 days.
©     That the EMS system is activated as soon as possible following an AED usage and any such usage must be reported to local EMS and a licensed physician.
©     Acquires of AED units shall have trained employees available to respond to an emergency that may involve an AED during normal operation hours.
©     There must be a written plan that describes the procedures to be followed in the event of an AED usage and to ensure compliance with a health and safety coach.
©     When an AED is placed in a building all tenants must annually receive a brochure with describes the use of an AED and this information must be posted next to any installed AED.
©     When an AED is placed in a building the tenants must be annually notified as to the location of AED(s).
 ©    When an AED is placed in a public school all school administrators and staff shall annually receive a brochure that describes the proper use of an AED.
©    There must be involvement of a licensed physician to develop and AED program and ensure ongoing compliance with regulations and requirements as stated above. 
©     Section 104113: As of July 1st 2007 every health studio defined as any facility permitting the use of its facilities and equipment or access to its facilities and equipment, to individuals or groups for physical exercise, body building, reducing, figure development, fitness training, and or any other similar purpose for a fee or membership basis must comply with the following: 
©     Facility will acquire an AED.
©     Facility shall maintain trained personnel in the use of AED.
©     Any employee of such health studio who renders emergency care is not liable for civil damages resulting from the use or non use of an AED
©     The facilities board of directors, owners, managers of such health studio who renders emergency care is not liable for civil damages resulting from the use or non-use of an AED.
©     In order to ensure public safety a health studio shall comply with all the regulations governing the placement of an AED as stated in California Health & Safety Code section 1797.196.
